Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of Blind Tasting, a free daily food geography game available at blindtasting.fun (the “Service”), operated by the operator of blindtasting.fun (“we”, “us”). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. The Service

Blind Tasting publishes one puzzle per day, identical for all players worldwide. The Service is provided free of charge. There are no prizes, entry fees, or purchases.

We may modify game mechanics, add or remove features, or discontinue the Service in whole or in part at any time. As the Service is free, we do not guarantee its continued availability.

2. Accounts (Food Passport)

Creating an account is optional and free. Authentication is via a magic link sent to your email address; no password is stored. You are responsible for maintaining access to and the security of your email inbox, as anyone with access to it can access your account.

We may suspend or delete accounts that we reasonably believe are being misused, including accounts used for automated play, abuse of the Service, or circumvention of these Terms. You may delete your account at any time; deletion of associated data is described in our Privacy Policy.

3. Acceptable Use

You agree not to:

  • access the Service through automated means (bots, scrapers, or scripts), except as permitted by standard search engine indexing;
  • attempt to disrupt, overload, or interfere with the operation of the Service;
  • attempt to gain unauthorized access to our systems or other users’ accounts;
  • use the Service for any unlawful purpose.

4. Intellectual Property

All content on the Service — including dish photographs, texts, clues, descriptions, design, and code — is owned by us or used with permission and is protected by copyright and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable right to use the Service for personal, non-commercial purposes. You may share your game results (the share card text) freely. Any other reproduction, scraping, or redistribution of Service content requires our prior written permission.

5. Availability and Warranty

The Service is provided free of charge and “as is”. To the extent permitted by law, we make no warranties regarding uninterrupted availability, freedom from errors, or the accuracy of puzzle content and clues. Occasionally a dish might stump everyone — that is part of the game.

6. Limitation of Liability

We are liable without limitation for damages caused by intent (Vorsatz) or gross negligence (grobe Fahrlässigkeit), and for injury to life, body, or health.

In cases of slight negligence (einfache Fahrlässigkeit), we are liable only for breaches of essential contractual obligations (Kardinalpflichten) — obligations whose fulfillment makes the proper performance of the contract possible in the first place and on whose compliance you may regularly rely. In such cases, our liability is limited to the foreseeable damage typical for this type of contract.

Any further liability is excluded. Liability under mandatory statutory provisions, including the German Product Liability Act (Produkthaftungsgesetz), remains unaffected.

7. Privacy

The processing of your personal data is described in our Privacy Policy.

8. Third-Party Services

The Service relies on third-party infrastructure providers (hosting, authentication, email delivery). We are not responsible for interruptions or failures originating from these providers, subject to Section 6.

9. Changes to These Terms

We may update these Terms from time to time, for example to reflect changes to the Service or legal requirements. The “Last updated” date at the top of this page reflects the most recent revision. If we make material changes, we will provide notice on the Service. If you continue to use the Service after the updated Terms take effect and do not object, the updated Terms apply. If you do not agree with a change, you should stop using the Service and may delete your account at any time.

10. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany. If you are a consumer residing in the EU, you additionally benefit from the mandatory consumer protection provisions of the law of your country of residence.

11. Severability

If any provision of these Terms is or becomes invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
